The Ecuadorian criminal statute does not expressly classify abuse of rights as a criminal offense, even though it does recognize certain manifestations of such unlawful conduct, which in some cases produce serious harm, affect the administration of justice, violate fundamental rights, or generate significant social risks. For this reason, the present study aims to analyze the dogmatic and exegetical foundations for the criminalization of the offense of abuse of rights within the Organic Comprehensive Criminal Code. Through a qualitative, dogmatic‑legal study based on documentary analysis, it was determined that the connection among the elements of unlawfulness, culpability, and punishability in constructing the criminal offense of abuse of rights requires considerations of dangerousness and compliance with the general‑prevention function of criminal law. The study concludes that it is necessary to reformulate the offense of procedural fraud and to incorporate a new offense – abuse of rights – covering the residual and structural scenarios in which the current legal framework leaves spaces of impunity in the face of systematic practices of instrumentalizing legal rights to cause harm to others.
