| dc.description | Este trabajo de investigación se origina bajo el análisis de los artículos 47.2 y 48 del Código de Trabajo ecuatoriano, en relación con las jornadas excepcionales y su adecuación a los principios constitucionales en torno a la jerarquía de la norma, la seguridad jurídica y el derecho al trabajo. Este estudio se extiende en un enfoque histórico y dogmático que permite conocer la evolución del ejercicio del derecho al trabajo, para comprender el origen del establecimiento de la jornada laboral, y los efectos de la aplicación de los acuerdos ministeriales que los regulan, en materia de jornadas especiales. Los resultados evidencian la existencia de vacíos legales y contradicciones constitucionales que pueden afectar la seguridad jurídica de los trabajadores, es por esto que se propone un texto de reforma normativa sobre los artículos antes mencionados, con el propósito de armonizarlos con el principio de trabajo digno y el bloque de constitucionalidad. | |
| dc.description.abstract | This research stems from an analysis of articles 47.2 and 48 of the Ecuadorian Labor Code, specifically regarding exceptional work schedules and their alignment with constitutional principles concerning the hierarchy of norms, legal certainty, and the right to work. The study employs a historical and doctrinal approach to understand the evolution of the right to work and the effects of applying the ministerial agreements that regulate these special work schedules. The findings reveal legal gaps and constitutional contradictions that could affect workers´ legal certainty. Therefore, a proposed reform to the aforementioned articles is presented aiming to harmonize them with the principle of decent work and the constitutional framework. | |
