It has been identified that Article 4, subsection (d), of the Regulations for the Ap-plication of the Disciplinary Regime of Book I of the Organic Code of Citizen Se-curity and Public Order Entities, by preventing the justification of a police officer’s absence on the grounds of a deprivation of liberty imposed against them, has gen-erated arbitrariness in practice. Accordingly, this paper addresses the violation of the right to the presumption of innocence arising from the application of the provi-sion. Through a qualitative approach supported by inductive and deductive meth-ods, and by means of documentary review and exegetical techniques, it was estab-lished that said rule is indeed inconsistent with due process in disciplinary matters. It is concluded that the provision requires amendment to modulate its interpretation across the various scenarios that may arise, to prevent injustices to the detriment of the constitutional guarantee of the presumption of innocence.
