| dc.description | Revisando la realidad jurídica se puede observar que el sistema ha venido poniendo especial atención a los mecanismos responsables de garantizar el derecho a la motivación en las decisiones judiciales; con la finalidad de respetar el debido proceso especialmente en los sumarios administrativos de la Policía Nacional del Ecuador. Al punto que se tome en cuenta el respeto y la razonabilidad de este derecho establecido y protegido en la normativa constitucional. La investigación tiene como objetivo Analizar la motivación en las resoluciones administrativas como garantía del debido proceso de los sumarios administrativos en la Policía Nacional del Ecuador: Estudio de la Zona 8. Período 2018-2022. La metodología fue de campo-descriptiva con enfoque cualitativo. Entre los resultados se señala que la debida motivación es un derecho obligatorio asumido por la autoridad administrativa. Concluyendo, que los principios del debido proceso debe asegurar y proteger la efectividad de los derechos de los ciudadanos. | |
| dc.description.abstract | Reviewing the legal reality, it can be observed that the system has been paying special attention to the mechanisms responsible for guaranteeing the right to motivation in judicial decisions; in order to respect the due process, especially in the administrative summaries of the National Police of Ecuador. To the point that respect and reasonableness of this established and protected right in constitutional regulations are taken into account. The objective of this research is to analyze motivation in administrative resolutions as a guarantee of due process in administrative summaries in the National Police of Ecuador: Study of Zone 8. Period 2018-2022. The methodology was field-descriptive with a qualitative approach. Among the results, it is pointed out that due motivation is a mandatory right assumed by the administrative authority. Concluding that the principles of due process must ensure and protect the effectiveness of citizen’s rights. | |
