En el contexto de la sucesión testamentaria, existen restricciones conocidas como "legítimas rigurosas" que limitan la libertad de disposición del testador. Estas legítimas rigurosas están destinadas a proteger los derechos de los herederos forzosos, quienes tienen derecho a recibir una parte de la herencia, independientemente de lo que establezca el testamento. En Ecuador, es importante comprender las implicaciones y alcances de estas legítimas rigurosas en la sucesión testamentaria, así como los derechos y deberes de los herederos involucrados en el proceso. Se ha dividido el presente trabajo en dos secciones siendo el primero la conceptualización de las características específicas de las legítimas rigurosas y su implementación en el derecho sucesorio y en la segunda sección la limitación al derecho de la libertad de testar y sus repercusiones en el derecho de los legitimarios.Inheritance law in Ecuador oversees regulating the transmission of assets and rights from a deceased person to his or her heirs. In the context of testamentary succession, there are restrictions known as "rigorous legitimate rights" that limit the testator's freedom of disposition. These, rigorous legitimate are intended to protect the rights of forced heirs, who are entitled to receive a part of the inheritance, regardless of what the will sets up. In Ecuador, it is important to understand the implications and scope of these rigorous legitimate rights in the testamentary succession, as well as the rights and duties of the heirs involved in the process.
