The central legal problem is to determine under which circumstances a dispute arising from a contractual relationship acquires a genuine constitutional dimension that justifies the protective action, and in which cases its use distorts this jurisdictional guarantee and undermines legal certainty as recognized in Article 82 of the Constitution of the Republic of Ecuador. The research followed a qualitative approach, applying legal-dogmatic, exegetical, and case-law analysis methods to the Constitution, the Organic Law on Jurisdictional Guarantees and Constitutional Control (LOGJCC), and judgments of the Constitutional Court issued between 2013 and 2024, selected because they directly resolve the admissibility of the protective action in contract-related matters. The main findings establish that the contractual origin of a dispute does not, by itself, render the protective action inadmissible; that this guarantee is neither residual nor subsidiary, so the existence of another judicial remedy does not allow its rejection in limine, but rather requires a reasoned analysis in the judgment regarding the nature of the claim, the existence of an actual violation of constitutional rights, and the adequacy and effectiveness of ordinary remedies; and that the Constitutional Court has declared such actions unfounded when the claim is limited to demanding the performance, interpretation, or termination of contractual obligations, exceptionally admitting the guarantee where verifiable constitutional violations, situations involving priority-attention groups, or the ineffectiveness of ordinary remedies concuresacción de proteccióncontroversias contractualesseguridad jurídicaimprocedenciagarantías jurisdiccionalesCorte Constitucional del EcuadorLA PROCEDENCIA DE LA ACCIÓN DE PROTECCIÓN EN CONTROVERSIAS CONTRACTUALES: LÍMITES CONSTITUCIONALES Y AFECTACIÓN A LA SEGURIDAD JURÍDICAThesis
