This essay analyzes the lack of specific legal regulation regarding Electric Mobility Vehicles (EMVs) and its impact on urban mobility in Guayaquil during 2023–2024. Despite the rise of these vehicles as sustainable transport alternatives, their unregulated growth has led to urban disorder, due to legal gaps that hinder proper public space management and law enforcement. This omission violates constitutional principles such as legality, legal certainty, and the right to safe and sustainable mobility. Legal consequences include the inability to impose sanctions, legal uncertainty for users and authorities, and institutional inaction. Through the analysis of national and international legal frameworks, the paper proposes legislative reforms including mandatory registration, speed limits, typified offenses, safety devices, and efficient institutional control. The proposal aims to strengthen the legal framework based on technical indicators that ensure legality, equity, and sustainability. Regulating EMVs is both urgent and essential to prevent urban chaos, guarantee citizens’ rights, and restore state legitimacy in the face of an expanding and emerging phenomenon.esMovilidad eléctricaregulación jurídicaorden urbanoGuayaquilseguridad jurídicavehículos de movilidad eléctricatransporte sostenible.ANÁLISIS JURÍDICO DE LA AUSENCIA DE REGULACIÓN ESPECÍFICA SOBRE VEHÍCULO DE MOVILIDAD ELÉCTRICA Y SU IMPACTO EN EL ORDEN DE LA MOVILIDAD URBANA EN GUAYAQUIL DURANTE LOS AÑOS 2023-2024Thesis
