The study focused on the analysis of the normative confrontation between certain constitutional and legal precepts that persist in Ecuador regarding adoption, which are manifestly discriminatory and limit the right to equal opportunities for married or de facto persons of the same sex who intend to have children by adoption in the Ecuadorian State. It is argued that the Constitution of the Republic of Ecuador and the Code of Children and Adolescents are legally discriminatory in this sense and contradict other rights that are also fundamental and are, in principle, guaranteed by the same instrument, such as the right to the family and the best interests of the child. It is shown that there is vast experience in the study of homoparental families from the sociological and psychological field, which has resulted in the fact that the children who have developed in this bosom manifest comparable indices of well-being when compared to a traditional or heterosexual family and, in turn, how this discriminatory requirement is paradoxical in allowing a single person the possibility of adopting, when after that, he can perfectly arrange a homosexual marriage or join de facto without breaking any legal rules.esIgualdaddiscriminaciónmatrimonio homosexualadopción homoparental.LA DISCRIMINACIÓN EN LOS PROCESOS DE ADOPCIÓN PARA PAREJAS DEL MISMO SEXO EN ECUADORThesis
