This paper analyzes the legal issues related to the dissolution of the marital partnership in cases of presumed death within the Ecuadorian legal system. The study is grounded in the principle of legal certainty established in Article 82 of the Constitution, which requires the existence of clear, coherent, and predictable legal norms that enable individuals to understand the legal consequences of their actions and to trust in the application of the law. Within this framework, the research examines Articles 70 and 189 of the Ecuadorian Civil Code, which establish different points in time for determining such dissolution. While Article 70 links it to the provisional possession of the missing person’s assets, Article 189 associates it with definitive possession, thereby creating a normative contradiction that generates legal uncertainty for both spouses and third parties. Furthermore, the study analyzes the legal nature of presumed death, its patrimonial effects, and its impact on asset administration, succession proceedings, and family stability. This lack of normative coherence may lead to divergent interpretations by legal practitioners, thereby undermining legal certainty. Finally, the paper concludes that this normative conflict constitutes a legal antinomy that violates the principle of legal certainty, highlighting the need for legislative reform to unify criteria and ensure greater normative clarity, patrimonial stability, and effective protection of the rights of the families involvedesSeguridad jurídicaAntinomia jurídicaMuerte presuntaSociedad ConyugalPosesión Definitiva.SEGURIDAD JURÍDICA EN LA DISOLUCIÓN CONYUGAL POR MUERTE PRESUNTA SEGÚN EL CÓDIGO CIVILThesis
