This research aimed to analyze the potential impact of administrative changes implemented by the Council of the Judiciary on specialized justice and on the guarantees related to the right to a competent judge in Ecuador. To conduct this study, the administrative powers related to the organization of the Judiciary were reviewed, paying particular attention to the application of Article 101 of the Organic Code of the Judiciary and its relationship with other regulations that protect effective judicial protection and due process. The Constitution of the Republic of Ecuador, the American Convention on Human Rights, the Organic Code of the Judiciary, legal scholarship, and other relevant legal sources were considered. The research employed a qualitative approach, analyzing legal sources and reviewing applicable regulations. As a result of this research, a proposed reform to Article 101 of the Organic Code of the Judiciary is presented. The aim is to establish criteria that allow for the necessary administrative changes to be made for the functioning of the Judiciary, while ensuring that these changes do not affect the specialization of the courts or the guarantees that protect individuals who access the justice system. In conclusion, clearer regulation of this provision can help maintain a balance between the administrative organizational needs of the Council of the Judiciary and the obligation to guarantee specialized, competent justice in accordance with the principles recognized in the Constitution and international human rights instruments.esjusticia especializadajuez competentetutela judicial efectivaConsejo de la Judicaturaartículo 23reforma jurídicaVIOLACIÓN A LA JUSTICIA ESPECIALIZADA A TRAVÉS DE LOS CAMBIOS ADMINISTRATIVOS IMPLEMENTADOS POR EL CONSEJO DE JUDICATURA.Thesis
