El apremio personal que existe por el incumplimiento del pago de dos o más pensiones alimenticias, es tomado como una garantía para efectivizar el cobro de las mismas, y a su vez, para garantizar el desarrollo y el crecimiento adecuado que debe tener todo niño, niña y adolescente. En el desarrollo de este articulo académico, he utilizado el método inductivo en base al análisis argumental realizado y a su vez, he utilizado la técnica cualitativa de análisis documental, en base al análisis de las normativas ecuatorianas. Es por este motivo, que el este trabajo de investigación tiene como finalidad dar a conocer el derecho que tienen los menores a recibir alimentos necesarios para su vital subsistencia, y de igual manera se dará a conocer las medidas que existen para que los alimentantes deudores eviten que se les restrinjan sus derechos, a través de un tipo de garantía o caución que les va a permitir evitar que sean privados de su libertad.This research work deals with the rights of minors and the payment of child support owed and not paid, its problem is based on the restriction that exists through the personal constraint, the right to freedom and the right to work. The personal constraint that exists due to the non-payment of two or more alimony payments, is taken as a guarantee to make effective the collection of the same, and at the same time, to guarantee the adequate development and growth that every child and adolescent should have. In the progress of this academic article, I have used the inductive method based on the argumentative analysis carried out and at the same time, I have used the qualitative technique of documentary analysis, based on the analysis of the Ecuadorian regulations.
