The purpose of this work is to verify if there is a violation of the constitutional rights of people identified by the Public Security Council and the State as members of organized crime groups, national or transnational; terrorist organizations and belligerent non-state actors, when exercising the action of domain forfeiture, which is established in the Organic Law of Domain Forfeiture. After the analysis carried out, it is determined that in fact, there are internationally and constitutionally guaranteed rights such as due process, especially the presumption of innocence and others such as property, which may be affected if asset forfeiture actions are initiated without due process. to determine if one is part of the members of the aforementioned groups and that this would not only be going backwards towards a criminal theory with little or no guarantee, such as the Criminal Law of the Enemy, but also seriously violating constitutional guarantees, therefore that it is necessary to immediately disapply the rule as unconstitutionalesderecho penal del enemigoacción de extinción de dominiodelincuencia organizada nacional y transnacionalterrorismoactores estatales no beligerantesgarantismo constitucional.DEL GARANTISMO AL DERECHO PENAL DEL ENEMIGO EN LA LEY ORGÁNICA DE EXTINCIÓN DE DOMINIOThesis
