This paper analyzes the principle of environmental non-regression within the Ecuadorian legal framework, understood as the prohibition against unjustifiably reducing the level of environmental protection previously achieved by the State. Although the 2008 Constitution recognizes nature as a subject of rights and enshrines both progressivity and the prohibition of regressive measures, a persistent tension remains between this formal recognition and certain normative decisions that may entail a setback in environmental protection. The legal problem addressed is whether this principle constitutes a binding and justiciable norm or a merely programmatic declaration lacking practical effectiveness. The main objective is to determine the normative scope and actual operativity of the principle within the Ecuadorian legal system. To that end, a qualitative approach and a legal-dogmatic method are employed, through the exegetical and systematic analysis of the Constitution, the Organic Code of the Environment, international instruments and the case law of the Constitutional Court. The study concludes that the principle constitutes a binding and justiciable norm whose effectiveness, however, remains conditioned upon the activation of judicial review against regressive normative developments.esNo regresión ambientalprogresividad de los derechosderechos de la naturalezaderecho ambiental ecuatorianocontrol de constitucionalidad.EL PRINCIPIO DE “NO REGRESIÓN AMBIENTAL” EN EL MARCO NORMATIVO ECUATORIANO: ¿MITO O REALIDAD?Thesis
