This paper addresses the use of biometric systems for attendance control at work, based on an exegetical and theoretical-legal analysis, to analyze whether it violates the principles of personal data protection under current Ecuadorian regulations. It establishes that biometric data is a sensitive and high-risk data category, and therefore its use must be carried out under strict legal standards. In general, it was concluded that both the Constitution and the Organic Law on Personal Data Protection establish a framework of limitations and restrictions that prevent arbitrariness. Furthermore, it is concluded that there are insufficient legal grounds to consider biometric attendance control a suitable, necessary, and proportional measure in relation to what is intended to be achieved. It is a reliable record of compliance with one of the many obligations of the worker related to their presence and punctuality, as it is possible to obtain it through other, less invasive means, except in very specific cases that are documented as such.esDatos personalesdatos biométricosdatos sensiblesproporcionalidadasistencia.EL USO DE SISTEMAS BIOMÉTRICOS PARA CONTROL DE ASISTENCIA LABORAL Y SU EFECTO EN ECUADORThesis
