| Resumen : | This research tries to show the intervention and the role of Governments in free markets and free competition. The first part of this document details how laws recognized and regulated the free markets and the free competition that emerged from and since commercial activities started. Also, the paper analyzes laws from different countries that gave way to market´s legal regulation and the legal control over them, since the free competition and business freedom are directly related to the liberty of trade, industries and economics which in turn are regulated by economics laws with the goal of having a fair and organized environment in the markets, protecting the interests of the consumers, competitors, enterprises and population in general. Furthermore, it analyzes the intervention of the Ecuadorian government in the markets and in free competition among companies. Also, this research presents the laws that currently regulate and control the economic activities, showing the benefits and limitations that the different laws represent for these activities |
| Descripción : | La presente investigación trata de demostrar la intervención que realiza el Estado en la libertad de empresa y libre competencia. La primera parte de este trabajo se centra en la forma en que el derecho reconoció y reguló la libre empresa y libre competencia que nacieron de las diferentes actividades comerciales realizadas en el pasado hasta la actualidad. De igual manera, se realiza un análisis global de normativas de diferentes países que dieron paso a la regulación jurídica de los mercados y el control jurídico sobre estos, ya que la libertad de empresa y libre competencia son relacionadas directamente con las libertades de comercio, industrias y económicas, las cuales son reguladas por el derecho económico con la finalidad de crear un ambiente justo y ordenado en los mercados, protegiendo los intereses de los consumidores, competidores, empresas y el interés público. Es así que también se analiza la intervención del Estado ecuatoriano en el mercado, la libre empresa y libre competencia y las normas que principalmente regulan y controlan las actividades económicas, donde se podrá encontrar desde beneficios hasta restricciones legales para dichas actividades. |
