dc.descriptionEl presente trabajo se centró en un análisis de la figura delictiva del abuso de información privilegiada y en el tratamiento que Ecuador le brinda a la misma. Se inició el análisis, mediante el estudio de un inventario legal, donde se detallaron los escenarios penalmente relevantes en cuanto a la reserva de información. De manera posterior se analizaron las características generales del delito, las cuales fueron de ayuda para encontrar el delito que subsume la conducta. Por lo cual, se concluyó que si bien la conducta de difundir información privilegiada se puede subsumir dentro de un tipo penal ya existente, existe un inconveniente y un vacío legal en cuanto al tratamiento brindado para el uso de la información privilegiada.es
dc.description.abstractThe present work focused on an analysis of the criminal figure of abuse of privileged information and on its treatment in Ecuador. The analysis was initiated, through the study of a legal inventory, where the criminally relevant scenarios regarding the privileged information were detailed. Subsequently, the general characteristics of the crime were analyzed, which were helpful in finding the crime that subsumes the conduct. Therefore, it was concluded that although the behavior of spreading privileged information can be subsumed within an existing criminal type, there is a problem and a legal void regarding the treatment provided for the use of privileged information.es
