dc.descriptionEl procedimiento de cobro que se realiza de manera forzosa, esto es, por la vía coactiva, es una potestad municipal otorgada para mantener la autonomía económica de la administración pública sin la intervención de la función judicial. La contrariedad de la normativa del Código Tributario y del Código Orgánico de Organización Territorial, Autonomía y Descentralización, donde la primera contempla la respectiva notificación, mientras que la segunda indica el inicio del proceso sin necesidad de notificación y la contraposición constitucional, del debido proceso y derecho a la defensa, es un tema que debe ser reformulado. El objetivo del presente trabajo consiste en revisar ambas normativas, de tal forma que se demuestre una posible incongruencia y así proponer una normativa interna con el fin de no vulnerar derechos de los contribuyentes municipales y no afectar la administración pública. En este contexto, como conclusión se propone una posible reforma al artículo 512 del Código Orgánico de Organización Territorial, Autonomía y Descentralización, en el que se indique que es necesaria la notificación del título de crédito por parte de los funcionarios, considerando lo estipulado en el Código Tributario..es
dc.description.abstractThe compulsory collection procedure, that is, by coercive means, is a municipal power granted to maintain the economic autonomy of the public administration without the intervention of the judicial function. The contrariety of the regulations of the Tax Code and of the Organic Code of Territorial Organization, Autonomy and Decentralization, where the first contemplates the respective notification, while the second indicates the beginning of the process without the need for notification and the constitutional opposition, due process and Right to defense, is a subject that must be reformulated. The objective of the present revision work will be to revise both regulations, in such a way that a possible inconsistency is demonstrated and thus propose an internal regulation with the purpose of not violating the rights of the municipal taxpayers and not affecting the public administration. As a conclusion, a possible reform to article 512 of the Organic Code of Territorial Organization, Autonomy and Decentralization is proposed, in which it is indicated that the notification of the credit title by the officials is necessary, considering the stipulated in the Tax Codees
